Prisoner Transfer Agreements (PTAs) allow British prisoners incarcerated abroad to serve the remaining part of their sentence in the UK.
This system has recently changed due to the European Framework Decision (2008/090/JHA – Transfer of Sentenced Prisoners Between Member States) which came into force in 2011. This decision, which runs alongside the regular transfer agreement, allows for prisoners to be transferred without agreeing to the transfer.

Do I Qualify For Prisoner Transfer To The UK?
In order to qualify for transfer:
➢ You must be British or have close links with the UK, usually recognized through permanent residence
➢ Your sentence must be final and not subject to any Appeals, apart from appeals pending at the European Court of Human Rights in Strasbourg
➢ Your offence must be recognized as an offence in the UK
➢ You must have a minimum time left to serve, usually 6 months
➢ Your fine penalties must be paid
Furthermore, your country of imprisonment must have an agreement in place with the UK.
Agreements are currently in place with the following countries:
Antigua & Barbuda
British Virgin Islands
Trinidad & Tobago
United Arab Emirates are currently considering entering into a transfer agreement.

There is no automatic right to transfer back to the UK.
You should be prepared for a lengthy, in-depth application process that can be rejected at any stage without explanation and which can take around 18 months in total.
