Historic Abduction of a Defective

The term ‘Defective’ is an unacceptable term in todays society but we use that purely to reflect the wording of the charge. 

An offence has been committed if the defendant took a defective woman out of the possession of her parent or guardian, and against the will of that parent or guardian, with a specific sexual purpose.

 

The offence can be committed by a man or woman against a woman or girl.

 

Defences to this offence include consent of the parent or guardian, passive conduct by the defendant, and insufficient interference with the possession of the woman.

 

The maximum sentence for this offence is two years’ imprisonment.
