Historic Indecency With Children
This information should be read together with our overview about historic sexual offences.
An offence is committed if a person has committed an act of gross indecency with or towards a child for the defendant’s sexual gratification. Physical contact is not necessary. The child’s involvement can be passive and consent is irrelevant.
The offence can be committed by a man or woman.
A genuine belief that the child was 16 or over is a defence.
Maximum sentencing is as follows:
- 10 years’ imprisonment for offences committed on or after 1 October 1997
- Two years’ imprisonment for offences committed prior to 1 October 1997
