Penetration of the vagina of a girl under 13 must be proved. Ejaculation is not necessary.

The girl’s consent is irrelevant as the offence is committed if intercourse took place and the girl was under 13. Mistake as to the girl’s age is no defence.

Maximum sentencing is as follows:

• Life imprisonment for the full offence
• Seven years’ imprisonment for an attempt
